Terms of Sale
Scope of Application
These Terms of Sale apply to any subscription to a paid Mingo plan ("Basic" and "Pro" plans), by any individual or legal entity ("the user"). Any subscription implies full and unconditional acceptance of these Terms of Sale.
Offers and Pricing
Mingo offers the following subscription plans:
- Free — free of charge, with limited usage quotas (messages, web searches, image analyses, etc.);
- Basic — €9 per month;
- Pro — €19 per month.
Prices are stated in euros. Details of the features and quotas included in each plan are available on the Pricing page of the website.
Payment Terms
Payment for Basic and Pro subscriptions is made by credit card via Stripe, a secure third-party payment provider. Mingo does not collect or store any credit card data: this information is processed directly by Stripe.
Duration and Automatic Renewal
- Basic and Pro subscriptions have no fixed term commitment.
- They are billed monthly and renew automatically each month on the same date, by charging the registered payment method, until cancelled by the user.
Cancellation by the User
The user may cancel their subscription at any time, without justification, via the subscription management portal (Stripe) accessible in their Mingo account settings. Cancellation takes effect at the end of the billing period already paid for: the user retains access to the features of their plan until that date, and no further charge will be made afterwards.
Refund Policy
Unless otherwise required by mandatory legal provisions, amounts paid for a subscription are non-refundable, including in the event of cancellation during a billing period or non-use of the service. The user retains access to the service until the end of the period already paid for, as set out in Article 5.
Right of Withdrawal
In accordance with Article L221-28 13° of the French Consumer Code, the 14-day right of withdrawal does not apply to digital content supplied on an intangible medium whose performance has begun with the consumer's prior express agreement and express waiver of their right of withdrawal. By subscribing to a paid Mingo plan and immediately accessing the features of the chosen plan, the user acknowledges and accepts this waiver of their right of withdrawal.
Price Changes
Mingo reserves the right to change the price of its subscriptions at any time. Any price change will be communicated to affected users before it officially takes effect, and before it is applied to a charge on their current subscription. If the user does not wish to continue their subscription at the new price, they may cancel it before the change takes effect, in accordance with Article 5.
Included Quotas and Usage
Each subscription plan includes usage quotas (number of messages, web searches, image analyses, image generations, files, etc.), detailed on the Pricing page and in the user's account settings. These quotas may be adjusted by Mingo, particularly during the Beta phase of the service, without this constituting a subscription price change within the meaning of Article 8.
Liability
Mingo strives to ensure the continuity and quality of the service, without however guaranteeing uninterrupted availability. Limitations of liability relating to the service and to content generated by artificial intelligence models are detailed in the Terms of Use.
Governing Law and Disputes
These Terms of Sale are governed by French law. In the event of a dispute concerning their interpretation or performance, the parties will endeavour to find an amicable solution. Failing an amicable agreement, the French courts shall have exclusive jurisdiction, subject to mandatory legal provisions applicable to consumers.
